These Terms of Service ("Terms") apply to dewfrond.com and everything you buy from it. The store is run by Ne Plus Ultra Ventures LLC, a California limited liability company doing business as Dewfrond ("Dewfrond", "we", "us"). By visiting the site or placing an order, you agree to these Terms, our Refund policy, Shipping policy and Privacy policy. If you don't agree, please don't use the site.

1. Who can order

You must be at least 18 years old, or the age of majority where you live, to place an order. We ship to US addresses only for now. Please give us accurate contact, billing and shipping details.

2. Our products are cosmetics

Dewfrond products are cosmetics for how skin looks and feels. They are not drugs or medical treatments, and they are not meant to diagnose, treat, cure or prevent any disease or condition. Results vary from person to person, and the results we describe on the site come with consistent use.

Use them safely. Read the full ingredient list before you buy, patch test each product first, keep products out of your eyes and away from children, and stop use if irritation occurs. Our DMAE Firming Cream contains almond oil (tree nut). If you are pregnant, nursing, have a skin condition or have questions about an ingredient, talk to your doctor before use.

3. Product information and images

We work to describe our products accurately. Some product and lifestyle images on the site are digital renderings, and packaging, color and texture can differ a little from what you see on your screen. If something you receive is not what we described, our Refund policy covers you.

Ingredient lists and packaging can change when our manufacturer updates a formula or label. The label on the product you receive is the one to follow.

4. Prices, offers and discounts

Prices are in US dollars and can change at any time before you place your order. Pack prices, bundle prices and add-on deals are applied automatically in your cart and are shown before you pay. Unless an offer says otherwise, deals can't be combined, and add-on deal prices apply to one deal item for each qualifying serum, pack or set in your cart.

If a price or offer on the site is wrong because of a mistake, we may cancel the order and refund you in full, even after we've confirmed it. We'll always tell you first.

5. Orders and payment

Your order is an offer to buy. We accept it when we ship it. We may refuse or cancel an order, or limit quantities, for example if an item is out of stock, an order looks fraudulent, or an order appears to be placed for resale. If we cancel an order you have paid for, we refund you in full.

Payments are handled by Shopify and its payment partners. You confirm that you are allowed to use the payment method you choose. Sales tax is added at checkout where required.

6. Shipping

Orders are fulfilled from the US by our fulfillment partner. Shipping times, costs and what to do about lost or late orders are in our Shipping policy. Free US shipping applies to orders over $50 unless an offer says otherwise.

7. Our 30-day money back promise

If you don't love how your skin looks, email us within 30 days of delivery and we'll refund what you paid for the product. No need to send it back. The promise covers one refund per customer. Full details, including damaged, wrong and missing items, are in our Refund policy.

8. Reviews and other content you send us

We only show real reviews from real customers, and we never edit what a review says. We may remove reviews or comments that are unlawful, abusive, off topic, contain personal information or advertising, or are not about a Dewfrond product. When you send us a review, photo or comment, you let us show it on our site, emails and social channels, with your first name and last initial. You confirm it is your own honest experience and that you have the right to share it.

9. Using the site

Please don't use the site for anything unlawful, try to break or overload it, scrape it, buy products to resell without our written permission, or misuse our offers (for example by opening extra accounts to claim the money back promise more than once). We may suspend access or cancel orders when this happens.

10. Our content

The Dewfrond name, logo, designs, text, photos and other content on the site belong to us or the people who licensed them to us. You may view and share pages for personal use, but you may not copy, sell or reuse our content without our written permission.

11. Other companies' services

Parts of the site rely on other companies, such as Shopify for the store and checkout, payment providers, our fulfillment partner and carriers, and apps for reviews and email. Their own terms and privacy policies apply to their services. Links to other websites are for your convenience, and we are not responsible for their content.

12. Disclaimer

Apart from the promises in these Terms and our Refund policy, and to the fullest extent the law allows, the site and products are provided "as is" and "as available", without other warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We don't promise that the site will always be available or free of errors. Nothing in these Terms limits rights you have under consumer protection law that can't be waived.

13. Limitation of liability

To the fullest extent the law allows, Dewfrond and Ne Plus Ultra Ventures LLC, and our members, employees and partners, are not liable for any indirect, incidental, special, consequential or punitive damages arising from your use of the site or products. Our total liability for any claim about an order is limited to the amount you paid for that order. Some states don't allow these limits, so they may not apply to you.

14. Indemnity

If you break these Terms or the law when using the site, and that leads to a claim against us, you agree to cover our reasonable losses and costs from that claim, including reasonable legal fees.

15. Governing law and disputes

These Terms are governed by the laws of the State of California, without regard to its conflict of law rules. Please contact us first. Most problems are solved quickly by email, and we'll try in good faith to sort out any issue within 30 days. If we can't, either of us may bring a claim in small claims court where you live, or in the state or federal courts located in San Diego County, California, and we both agree to those courts' jurisdiction.

16. Changes and other terms

We may update these Terms from time to time. The version posted when you place an order applies to that order, and the "Last updated" date shows the latest change. If any part of these Terms can't be enforced, the rest still applies. If we don't enforce a part of these Terms right away, we can still enforce it later. These Terms, together with the policies linked above, are the whole agreement between you and us about the site and your orders.
